Terms and conditions for DMG online seminars and DMG in-person events

A. Online seminars

I. Registration and conclusion of contract

Registration by means of the registration form provided is required to attend an online seminar.

Attendance takes place exclusively in the context of the attendee’s commercial, self-employed or professional activity. The attendee does not act as a consumer under the terms set out in section 13 of the German Civil Code (BGB) when registering and attending.

By submitting the registration form, you are making an offer to attend.

The contract is only concluded when we have confirmed your registration (e.g. by emailing you with your login credentials).

Registered individuals are not entitled to attend DMG events. We reserve the right to reject registrations on legitimate grounds, in particular in cases of overbooking, where the event is not relevant to the registered individual’s field or for other organisational reasons.

The registration deadline is generally one day before the event begins, unless otherwise stated in the relevant seminar description.

II. Services

Once your registration is confirmed, you will receive access to the online seminar you have booked.

Attendance includes:

  • Attendance of the live online seminar

Other services (e.g. materials or recordings) will only be provided where this is expressly stated in the relevant seminar description.

III. Costs

The online seminars are free to attend.

IV. Cancellation / non-attendance

Cancellation of attendance is possible at any time, without any need to state reasons for doing so.

No costs or claims will arise in the case of non-attendance.

V. Delivery on Zoom

The online seminars are delivered on the platform Zoom.

Attendees are responsible for ensuring that the necessary technical requirements for attendance are met (in particular having a stable internet connection and installing the Zoom software).

Use of Zoom is subject to Zoom’s terms of use and privacy policy.

Where the online seminars are delivered on Zoom, Zoom will also process personal data in accordance with its own terms. We have only limited influence over individual processing operations carried out by Zoom.

VI. Cancellation or changes

We reserve the right to cancel or postpone the online seminar for due cause, in particular in the case of:

  • Technical problems
  • Speaker cancellation
  • Other unforeseeable events

Registered individuals are not entitled to the event taking place.

We reserve the right to make changes to the time, content or speakers, provided that such changes are reasonable for the attendees.

VII. Liability

We are liable without limitation for wilful misconduct and gross negligence, and for losses or damages arising from injury to life and limb or harm to health.

We are not liable for technical problems that attendees encounter – in particular connection problems, failure to meet technical requirements or software errors – to the extent that they are not attributable to us.

In cases of ordinary negligence, we shall be liable only for breaches of material contractual obligations (cardinal obligations), and only up to the foreseeable losses or damages typical of this type of contract.

Liability for indirect losses or damages, consequential losses or damages, lost profits, unrealised savings and other purely financial losses is excluded in cases of ordinary negligence, to the extent permitted by law.

IX. Protection of event content / copyright

All content of the online seminars – in particular presentations, training materials, recordings, images, texts, graphics, trademarks and other materials – is protected by law, in particular under copyright law and, where applicable, under other intellectual property rights.

The content may only be used in the context of the booked / approved attendance. Any reproduction, adaptation, distribution, public performance, recording, transmission to third parties or other use beyond what is permitted by law or without our prior express consent is prohibited.

Attendees are obligated to observe existing copyrights, trademarks and other intellectual property rights.

VIII. Data protection

Information on the processing of personal data can be found in our privacy policy.

X. Final provisions

Should individual provisions set out in these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods, to the extent permitted by law.

Where the attendee is a merchant, a legal entity under public law or a special fund under public law, or does not have a general place of jurisdiction in Germany, Hamburg shall be the place of jurisdiction for all disputes arising from or in connection with this contractual relationship, to the extent permitted by law.

B. Paid DMG in-person events

I. Registration

Registration for an in-person event is completed by means of the booking platform Eveeno.

By completing the booking process on Eveeno, you are making a binding offer to enter into an attendance agreement.

The agreement is only concluded on our acceptance, which is generally effected by an automated or manual registration confirmation sent by email.

Registration is processed using Eveeno as the technical platform. However, the contracting party for delivery of the event is exclusively DMG Dental Material GmbH.

Attendance takes place exclusively in the context of the attendee’s commercial, self-employed or professional activity. The attendee does not act as a consumer under the terms set out in section 13 of the German Civil Code (BGB) when registering and attending.

II. Services

Once your registration is confirmed, you secure your place to attend the in-person event you have booked.

The scope of services is set out in the relevant event description on the DMG website and on the registration form on Eveeno.

III. Costs

Attendance fee: The prices for each DMG in-person event can be found directly in the description of the individual dates. Payment is processed by means of the payment methods that the Eveeno platform offers during the booking process.

IV. Cancellation

Cancellation is possible at any time in text form (e.g. by emailing training(at)mtcompanies.com or, where available, using the cancellation function in Eveeno).

In the case of cancellation, we may claim a flat-rate cancellation fee in lieu of calculating actual losses and damages. The flat rate takes into account the expenses ordinarily saved and the possibility of reallocating the attendance place. The following flat rates apply:

  • Up to 14 days before the event begins:
→ flat-rate cancellation fee of 50% of the attendance fee
  • Fewer than 14 days before the event begins, or in the case of non-attendance:
→ flat-rate cancellation fee of 100% of the attendance fee

The attendee expressly reserves the right to demonstrate that we incurred no or only significantly lower losses or damages. Equally, we reserve the right to demonstrate that higher losses or damages were incurred.

A substitute attendee may be nominated at any time.

Amendment / cancellation of the DMG in-person event
We reserve the right to cancel the event for due cause, in particular in the case of:

  • Speaker cancellation
  • Insufficient number of attendees
  • Force majeure

In such cases, any attendance fees already paid will be refunded in full.

Any further claims asserted by attendees are excluded, subject to binding statutory provisions to the contrary.

We reserve the right to make programme changes, provided that such changes are reasonable for the attendees.

VI. Liability

We are liable without limitation for wilful misconduct and gross negligence, and for losses or damages arising from injury to life and limb or harm to health.

VII. Use of the Eveeno platform

We use the Eveeno platform for booking and payment processing purposes.

Eveeno’s terms of use and privacy policy also apply.

We have only limited influence over Eveeno’s data processing operations.

VIII. Protection of event content / copyright

All content of the in-person events – in particular presentations, training materials, images, texts, graphics, trademarks and other materials – is protected by law, in particular under copyright law and, where applicable, under other intellectual property rights.

The content may only be used in the context of the booked attendance. Any reproduction, adaptation, distribution, public performance, transmission to third parties or other use beyond what is permitted by law or without our prior express consent is prohibited.

Attendees are obligated to observe existing copyrights, trademarks and other intellectual property rights.

IX. Data protection

Information on the processing of personal data can be found in our privacy policy.

X. Final provisions

Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
